Las Cruces – The Las Cruces Public Schools and a family whose child died in 2007 have reached a settlement in the family's wrongful death lawsuit against the school district.
An attorney representing the district says the lawsuit was settled for $130,000.
Candi Martinez sued in April 2008 after her 7-year-old daughter, Destinie, collapsed during an elementary school physical education class and later died.
The lawsuit said Destinie became ill at school and began vomiting after being allowed to sit out. The child had undergone multiple surgeries for a heart defect.
The lawsuit alleged the school was negligent in efforts to provide emergency medical care and let an ill child participate in physical activity.
