Texas Court Votes To Preserve Gay Marriage; No Divorce Allowed

Texas – A Texas court of appeals has ruled that gay couples legally married in other states cannot get a divorce in Texas, where same-sex marriages are banned.

The 5th Texas Court of Appeals ruled Tuesday that a Dallas judge did not have jurisdiction to grant a divorce to two Dallas men who wed in Massachusetts.

The Dallas judge had also ruled that Texas can't limit marriage to being between a man and a woman. The appeals court said Texas' laws against same-sex marriage don't violate the Constitution.

The Dallas men, known only as J.B. and H.B. in court filings, married in 2006 in Massachusetts and separated two years later.

An attorney for J.B. said Tuesday that they had not yet decided whether to appeal to the Texas Supreme Court.
