Las Cruces – Las Cruces Police have charged a husband and wife after it was determined they used a BB gun to commit a drive-by shooting.
Jeremy Marta and Samielle "Mia" Diaz-Marta, both 20 and of the 5300 block of Sierra Vista Avenue, are charged with one count each of aggravated assault using a deadly weapon and conspiracy to commit an aggravated assault. Both counts are fourth-degree felonies.
Las Cruces Police detectives learned that shortly before 9 p.m. on Tuesday, Oct. 19, Jeremy and Samielle Marta, in a Nissan Pathfinder driven by Jeremy, were on Bataam Memorial East when they pulled up along side a vehicle carrying Jeremy's ex-girlfriend and her boyfriend. After yelling profanities at the victims, Samielle Marta grabbed a BB gun and fired several shots at the other vehicle.
The victims' vehicle was struck several times but no injuries were reported.
Police found Jeremy and Samielle Marta a short time later at their residence. The CO2-powered BB gun was located and taken into evidence.
Jeremy Marta and Samielle Diaz-Marta were both transported to the Dona Ana County Detention Center with bonds set at $10,000 each.
